Terms and Conditions for Loyalty Program Participants

Effective Date: 1st August 2025

A. Program Terms and Conditions

1. Introduction

1.1. Sika® MY Rewards loyalty program(“Program”) is brought to you by Sika Kimia Sdn Bhd (‘Organizer’/’Sika’).
1.2. These terms and conditions (“Terms”) govern the access, participation, redemption of rewards, eligibility of rewards of the users of the Program.

1.3. The Program is introduced and implemented in Malaysia only and is solely meant for the retail end users of Sika products. The Program is open only for all legal residents of Malaysia above the age of 18 years, except the employees of Organizer/Sika and their family members, Organizer's/Sika’s associate companies its distributors, its agents, its advertising and promotional agencies and its auditors and their associate companies.

1.4. The Program is applicable only for selected products, products without this Program will also be available in the market. The Organizer’s/Sika’s commitment under the Program is subject to a limited number of entries and the Organizer/Sika may limit the number of winners depending on the number of entries received.

 

2. Details of Program

2.1 The end use buyer of the selected Sika product from a retail store will obtain a QR code affixed on the product. For those selected products in this Program without the QR code, official receipt/invoice will be used as evidence of purchased. 

2.2 To obtain the reward points, end user buyer must scan the QR code. The value of the Product in terms of the reward points is stated in the Program Application. The QR code shall be valid for a term of one year from the date for manufacturing of the product. The value of the reward points is formulated at the rate of conversion of one reward point equivalent to RM0.01 and/or reward points can be accumulated to redeem for vouchers/ gifts listed on the Program Application. The rewards points validity is 12 months from the date points are claimed and the reward points if not redeemed within the end of the 12th calendar month shall be forfeited. The reward points cannot be transferred. 

2.3 For Products without the QR code, end user buyer must scan the official receipt /invoice and submitted within 30 days from the date of purchase, to obtain the reward points. The value of the reward points is formulated at the rate of conversion of one reward point equivalent to RM0.01 and/or reward points can be accumulated to redeem for vouchers/ gifts listed on the Program Application. The rewards points validity is 12 months from the date points are claimed and the reward points if not redeemed within the end of the 12th calendar month shall be forfeited. The reward points cannot be transferred. 

2.4 The Program can be terminated or withdrawn without any prior notice; any rewards points collected before Program withdrawal will be redeemed as per terms and conditions mentioned herein.

 

3. Redemption Of Rewards

For the redemption of the reward points, end user buyer needs to take the following steps:

3.1 download the Program App ‘Sika® MY Rewards from the Apple App Store, Android Play Store, access via WhatsApp, or visit the web URL (www.sikausetada.com) to register and participate in the rewards program.

3.2 provide full name and mobile number and agree to the Program terms and conditions and terms of use.

3.3 Input the One Time Password (“OTP”) received via SMS or WhatsApp text on the registered mobile number. Once the end user buyer, inputs the OTP, he/she becomes the Member of the Program and indicates his/her acceptance to the Program terms and conditions including the terms of use.

3.4 For registration and participation purposes, the end user buyer will be sharing personal data such as Name, Age, ID proof, location, if applicable and any other data about himself/herself making him/her identifiable by or in relation to such data (Personal Data). The end user buyer by accepting this terms and conditions gives its unconditional consent to the Organiser/Sika (Data Controller) and the service provider (Data Processor) to collect, store and process the personal data of the end user buyer in accordance with the applicable laws, data privacy policy (as stated hereinafter) and only for the purposes of the Program i.e. 

i. anticipation, identity identification and redemption of gifts/rewards;
ii. storing the Personal Data of the end user buyer until the consent is withdrawn by the end user buyer.


3.5 End user buyer acknowledges that the Program App is hosted and maintained by a third-party service provider and such service provider shall be the data processor in terms of the data protection laws.

3.6 The end user buyer/Member upon completion of all the steps as stated above will be redirected for redemption of the reward points. For redemption, the end user buyer/Member may opt for (a) gift voucher (b) gifts as available on the Program Application. 

 

B. TERMS OF USE OF THE APP, REWARD REDEMPTION, DATA PRIVACY AND PROTECTION

i. End User Buyer agrees and acknowledges that the Sika® MY Rewards Program is hosted on the App developed and provided by a third-party service provider TADA SDN BHD and the use of the App, enrolment for membership, redemption of rewards, data sharing, storing and processing is governed as per the Terms of Use of the TADA Sdn Bhd as reproduced here in below:

ii. PLEASE READ THESE TERMS OF USE (“Agreement”) CAREFULLY. BY DOWNLOADING, ACCESSING, BROWSING OR UTILIZING ANY SERVICES ON Sika® MY Rewards App, AN APPLICATION FOR MOBILE AND HANDHELD DEVICES (“Platform”), YOU CONSENT TO BE BOUND BY THIS TERMS OF USE AND OTHER POLICIES (INCLUDING BUT NOT LIMITED TO ANY REFUND AND/OR CANCELLATION POLICY AND PRIVACY POLICY) AS POSTED ON THE PLATFORM FROM TIME TO TIME, WHICH TAKES EFFECT ON THE DATE ON WHICH YOU DOWNLOAD, INSTALL OR USE THE SERVICES, AND CREATES A LEGALLY BINDING AGREEMENT. IF YOU DO NOT WISH TO BE BOUND BY THIS AGREEMENT, KINDLY DO NOT ACCESS OR UTILIZE THE PLATFORM AND PLEASE DELETE/REFRAIN FROM ACCESSING THE SAME.

iii. The application Sika® MY Rewards is hosted managed and maintained TADA Sdn Bhd [Company No. 202101004241 (1404540-P)] (hereinafter “Company”), a company incorporated in Malaysia under the Companies Act, 1965 and having its registered office at Common Ground Petaling Jaya, G.016, Ground Floor & 1.013 First Floor, The Square, Jaya One, 72A, Jalan Prof Diraja Ungku Aziz, Seksyen 13, 46200 Petaling Jaya, Selangor.

iv. For the purpose of these Terms of Use, wherever the context so requires, the terms, “we”, “us” or “our” shall mean TADA Sdn Bhd. “You” shall mean any natural or legal person who is a “Visitor” (which means that you are merely browsing our Platform) or a “Member” (which means that you have registered with the application as a user). As long as You comply with these Terms of Use, we grant You a non-exclusive, non-transferable, limited right to enter and use our Platform and services.

v. Sika® MY Rewards is a platform that provides Members and other users incentives with other features such as product information, product selectors, coverage calculators, information in relation to events, registrations for the same, etc. Sika® MY Rewards also allows the Members / User to check their balance and redeem the points that have been accumulated.

 

C. AMENDMENTS

We reserve the right to modify the contents of this Terms of Use from time to time, and such modification shall come into effect from us posting the modifications on our Platform. You agree to be bound by any such modification to these Terms when You use the Platform subsequent to such modification. You shall, at all times, be responsible for regularly reviewing the Terms of Use and the other policies.

 

D. REGISTRATION OR USE OF THE PLATFORM

i. You must be 18 (eighteen) years or older to visit/register the Platform. By registering and using the services you agree that you are eighteen years or above and you are not barred by any law to contract and you agree to have read and accepted the terms and conditions provided herein. We are under no obligation to accept a request for registration.

ii. You may access the Platform by registering to create an account (“Sika® MY Rewards”) through three channels: (a) WhatsApps, (b) mobile app, and (c) web URL (https://sikamyrewards.usetada.com/) by providing your full name and mobile number. Once registered, you will receive a One Time Password (“OTP”) via SMS or via WhatsApp on the mobile number for user authentication, if you registered via Mobile Apps or Weblink. When you input the OTP on the Platform, you may become a member (“Membership”).

iii. By registering your mobile number with us, you consent to receive, via phone calls or SMS or WhatsApp’s notifications subscription/service updates/information in relation to events, promotions, etc. You have the option to "opt-out" of receiving future communications or request for your name to be deleted from our mailing lists by contacting the email address given below. We do not guarantee that all communications sent by us will be delivered in its entirety to you. You acknowledge that you are responsible for all charges and permissions required for accessing our Platform through your mobile network provider.

iv. You agree to provide accurate and complete information about yourself while registering on our Platform as a Member and ensure to promptly update your registration data to keep it up to date and complete. In the case we are unable to establish your unique identity against a valid mobile number, your account shall be indefinitely suspended.

v. You are permitted to have only have one Sika®MY Rewards account at any given point in time. If you fail to comply, we reserve the right to suspend such multiple accounts without being liable for any compensation.

vi. We reserve the right to disclose to third parties’ certain data, not including personal data, related to You. If we are required to share your personal information, (1) You may expressly permit us to do so or (2) we are bound to share such personal information by way of any applicable law or legal process.

vii. We reserve the full discretion to suspend your account in the event you fail to comply with any of the terms mentioned herein and do not have any liability to share any account information whatsoever.

 

E. SERVICES OFFERED

i. Sika® MY Rewards provides a number of internet-based services through the Platform like redeeming points pursuant to a claim code upon the purchase of a product, or pursuant to valid official receipt / invoice, check balance of the points available for you, redeem the points either for vouchers or gift, as provided in the gift brochure (“Gift”),

ii. Upon becoming a Member, you must scan the QR code as received by you on the Sika product purchased by you or scan the official receipt / invoice of the purchased product and submit and the corresponding points shall be credited to your account on the Sika MY Rewards App. 

iii. You can either redeem the points for the available gifts as available on the Platform, as per the Gift Policy. The Gift along with the points required to purchase the Gift is available in the Gift Policy. The maximum retail price of the gifts may not match the number of points required to purchase the Gift and neither we nor the Organizer/Sika gives any warranty, guarantee or assurance on the quality, use or purposes of the gift selected by you.

iv. If in a transaction performed by you on the Platform, there is a change in points, or you experience any issues or did not receive your redeemed voucher or gift within 14 working days, you can either contact the us via WhatsApp or the mobile Apps platform by using the “Contact Us” button and have a live chat with us or you can use the call option to contact us. We or Organizer/Sika does not take any liability for timely disbursements or delivery of the redeemed voucher/gifts. You hereby release us and the Organizer/Sika from any claims arising out of or in connection with the delay in the rewards points, disbursement, delivery of gifts, damages caused to the voucher / gift products in transportation or any related loss or cost.

 

F. REWARDS AND POINTS

i. Points cannot be redeemed for cash or transfer to accounts for payment of account invoices. Points cannot be transfer from one mobile number to another mobile number that registered under the same name. Points are not transferable to another Member or any entity. 

ii. The points have an expiration of 12 months from the date of crediting into your account on the Sika® My Rewards App. All unused points within 12 months period will be forfeited. 

iii. The Points may be exchange for e-vouchers and Gifts from a number of merchants listed in the Platform. The Points can be redeemed for a wide range of rewards items and offers listed in the reward catalogue section of Sika® My Rewards program platform at the time of redemption. 

iv. Points may be redeemed at any time for rewards. Your points balance must be sufficient for the reward you wish to acquire. The range of rewards will change from time to time, without notice and are subject to availability. And the number of points required to redeem any reward may change at any time without notice. 

v. The ordering and delivery of rewards is subject to the merchants’ terms and conditions upon check-out. The time taken to deliver a reward will vary per merchant. Sika and/or TADA Sdn Bhd shall not be liable for any delay in delivery of a Reward item. 

vi. Member will be notified via WhatsApp upon claiming the e-voucher online. Voucher code/s will be sent through this Channel.

vii. When an order has been processed, the request cannot be amended, withdrawn or exchanged for another reward or offer.

viii. All rewards will appear in the reward list and will be available for redemption. Rewards that are no longer available will be removed from the catalogue. 

ix. If there are any issued during the reward redemption process, the points will be returned to the member’s account. 

x. Any warranty claims must be taken up directly with the reward merchant should a warranty issue arise. Sika and/or TADA Sdn Bhd shall not be liable for any defects, deficiencies or any loss or damage caused by any of the Rewards. Member may refer to the terms and conditions of the merchants or may reach out directly to them. 

xi. where a reward takes the form of a voucher or a gift card, it must be used before the expiry date stated therein, voucher’s expiry date applies as specified by each merchant, Member may refer to the merchant fine print for details.
 
xii. Sika is not responsible or liable for any loss of redemption points where the reduction or redemption is not authorized. 

xiii. Members must only use its own points for rewards redemption. Sika will not be accountable if another Member uses another member’s account or points.  Member must not use another Member’s account or points to redeem for rewards. Points may not be pooled with other Member to redeem rewards.

 

G. GIFT POLICY

i. TADA Sdn Bhd do not own, sell, resell on its own and/or do not control any of the products given as gifts. You understand that any Gift purchased by you shall be subject to the terms and conditions set out in these Terms of Use including, but not limited to, product availability and delivery location serviceability. In the event the Gift is unavailable or undeliverable for any reason whatsoever, you will be notified as soon as reasonably possible and the points will be returned to your account. The Organizer/Sika and TADA Sdn Bhd hereby expressly reject and disclaim any warranties or guarantees for the gift products, its availability or the timelines for delivery.

ii. The Voucher / Gifts will be restricted to the items listed on the Platform.

iii. The validity and expiration of the redemption vouchers are the responsibility of TADA Sdn Bhd.

iv You consent to paying any additional costs for shipping, taxes, etc for delivery of the Gift.

v. Once a Gift is purchased by way of the reward points, we do not offer any refunds or exchanges against the same.

vi. TADA Sdn Bhd disclaims and waives any liability arising out of any incorrect or inaccurate warranty in relation to the specifics (like description, quality, marketability, servicing, etc.) of the Gift.

vii. The images of the Gifts shown are for visual representation only and may vary from the actual product.  viii Product warranty in relation to the Gift shall be regulated by the terms and conditions mentioned on the warranty card of respective products and TADA Sdn Bhd or the Organizer/Sika shall not be liable or responsible to you for any direct, associated or indirect or consequential loss or damage. 

 

H. USER CONDUCT

You agree, undertake and confirm that your use of the Platform shall be strictly governed by the following binding principles:

You shall not directly or indirectly do or cause any action, on the Platform, which: 

i. Promotes information that you know is false or misleading or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libelous, including a photograph of another person that you have posted without that person’s consent or otherwise constitutes an invasion of an individual’s privacy or infringement of publicity rights.

ii. Involves commercial activities and/or sales without TADA Sdn Bhd’s prior written consent, such as contests, sweepstakes, barter, advertising, and/or pyramid schemes

iii. Provides any telephone numbers, street addresses, last names or email addresses of anyone other than your own.

iv. Solicits passwords or personal identifying information from other Members/Users

v. Harasses or advocates harassment of another person
vi. Involves the transmission of “junk mail,” “chain letters,” or unsolicited mass mailing, instant messaging, “spimming,” or “spamming”

vi. Furthers or promotes any criminal activity or enterprise or provides instructional information about illegal activities including, but not limited to making or buying illegal weapons, violating someone’s privacy, or providing or creating computer viruses.

viii. Post, shares or promotes any type of material, articles, photos, videos or fake news which Is/are offensive and/or promotes racism, religious bigotry and/or, hatred or physical harm of any kind against any group or individual.

ix. Exploits people in a sexual or violent manner xi Contains nudity, violence, pornography, sexually explicit material or offensive subject matter

xii. You shall not pretend that you are, or that you represent someone else, or impersonate any other individual or entity.

xiii. You shall not use the Platform or any content on the Platform for any purpose that is unlawful or prohibited by these Terms of Use, or to solicit the performance of any illegal activity or other activity that infringes the rights of TADA Sdn Bhd.

xiv. You shall not make any negative or defamatory statement(s) or comment(s) about us or our domain name or the name Sika® MY Rewards or engage in any conduct or action that might tarnish the image or reputation, of TADA Sdn Bhd and/or the Organizer/Sika on Platform or otherwise tarnish or dilute any TADA Sdn Bhd’s trade or service marks, trade name and/or

xv. You shall not launch any “page-scrape”, “deep-link”, “spider”, “robot”, or other automatic device, program or code etc. to access, copy or monitor any portion of the Platform, to acquire or attempt to acquire any materials, documents or information through any means not intentionally available on the Platform. We reserve our right to prohibit any such activity and suspend your account immediately. 

xvi. You agree that you will not take any action that imposes an unreasonable or disproportionately large load on the infrastructure of the Platform or TADA Sdn Bhd’s systems or networks.

xvii. You shall not attempt to gain unauthorized access to any portion or feature of the Platform, or any other systems or networks connected to the Platform or to any server, computer, network, or to any of the services offered on or through the Platform, by hacking, “password mining” or any other illegitimate means. 

xviii. You agree not to use any device, software or routine to interfere or attempt to interfere with the proper working of the Platform or any transaction being conducted on the Platform, or with any other person’s use of the Platform.

xix. You shall at all times ensure full compliance with the applicable provisions, as amended from time to time.

xx. “Your participation in, and use of the program is contingent on compliance with the Terms and all relevant Sika® policies, including but not limited to Sika®’s privacy policy and any promotional terms and conditions that Sika® may run from time to time.”

 

I. DISCLAIMER AND LIMITATION OF LIABILITY

i. TADA Sdn Bhd’s and the Organizer/Sika does not warrant or represent that the material on the platform is accurate, complete or current or that the website will be free of defects or viruses.

ii. All the materials and products (including but not limited to software) and services, included on or otherwise made available to you through the Platform, are provided on "as is" and "as available" basis without any representation or warranties, express or implied except otherwise specified in writing.

iii. TADA Sdn Bhd and the Organizer/Sika shall not be liable to you or anyone else for any losses or injury arising out of or relating to the information provided on the Platform. In no event will we or our employees, affiliates, authors or agents be liable to you or any third party for any decision made or action taken by your reliance on the content contained herein.

iv. You acknowledge that third party services may be available on the Platform. We may have formed partnerships or alliances with some of these third parties from time to time in order to facilitate the provision of certain services to you. However, you acknowledge and agree that at no time are we making any representation or warranty regarding any third party’s services or products nor will we be liable to you or any third party for any consequences or claims arising from or in connection with such third party including, and not limited to, any liability or responsibility for, death, injury or impairment experienced by you or any third party. You hereby disclaim and waive any rights

v. In no event shall TADA Sdn Bhd or the Organizer/Sika be liable for any indirect, punitive, incidental, special, consequential damages or any other damages resulting from:

vi. the use or the inability to use the Platform, services, products, vouchers or Gift

vii. unauthorized access to or alteration of the user's transmissions or data

viii. breach of condition, representations or warranties by the manufacturer of the Gift or the products, and vouchers displayed on the Platform.

ix. any other matter relating to the services including, without limitation, damages for loss of use, data or profits, arising out of or in any way connected with the use or performance of the Platform or service. TADA Sdn Bhd and the Organizer/Sika shall not be held responsible for non-availability of the Platform during periodic maintenance operations or any unplanned suspension of access to the Platform. Any material and/or data downloaded from the Platform is solely at your own discretion and risk and you will be solely responsible for any damage to your mobile or loss of data that results from such download.

 

J. WAIVER OF LIABILITY

You agree and acknowledge that no delay or decision not to enforce rights under this Agreement will constitute a waiver of the right to do so and will not affect rights in relation to any subsequent breach.

You agree and acknowledge that TADA Sdn Bhd and the Organizer/Sika will, however, not be liable for any loss or damage (in contract, negligence or otherwise) where:

i. There is no breach of a legal duty of care owed to you by us;

ii. The loss or damage is not a reasonably foreseeable result of any such breach; or

iii. Any loss or damage or increase in loss or damage results from a breach by you of these terms and conditions.

iv. TADA Sdn Bhd and the Organizer/Sika or its directors shall not be liable for any direct, indirect, consequential or other damages caused to the Member/ User. 

 

K. THIRD PARTY RIGHTS

i. Nothing in this Agreement is intended to nor shall confer a benefit or any legal rights on any third party and/or any person who is not a party to this Agreement, and has no rights to enforce them.

ii. Theft of handheld device or suspected misuse of your account by a third party:

iii. In the event that you have lost your handheld device or suspect or have reason to believe that a third party has had unauthorized access to your account, you shall inform us immediately of the same and your account shall be temporarily suspended. We shall attempt to provide a fresh password and keep your information as safe as practicably possible.

iv. We shall not be held responsible or be liable to you in whatever circumstances, for any misused of your account by any third party who have access to your account whether it is authorized or unauthorized, and whether notice or report has been lodge with us by you of any unauthorized access to your account. 

 

L. INDEMNITY

You shall indemnify and hold harmless the Organizer/Sika, TADA Sdn Bhd their owner, licensee, affiliates, subsidiaries, group companies (as applicable) and their respective officers, directors, agents, and employees, from any claim or demand, or actions including reasonable legal fees, made by any third party or penalty imposed due to or arising out of your breach of this Terms of Use, privacy Policy and other Policies, or your violation of any law, rules or regulations or the rights (including infringement of intellectual property rights) of a third party. 

 

M. INTELLECTUAL PROPERTY RIGHTS

All materials on our Platforms, including, without limitation, names, logos, trademarks, images, text, columns, graphics, videos, photographs, illustrations, artwork, software, and other elements (collectively, “Proprietary Information”) are protected by copyrights, trademarks and/or other intellectual property rights owned and controlled by Sika AG with respect to Sika intellectual property rights and TADA Sdn Bhd with respect to TADA Sdn Bhd intellectual property rights. You acknowledge and agree that all content on our Platforms is made available for limited, noncommercial, personal use only. Except as specifically provided herein or elsewhere in our Platforms, no Proprietary Information may be copied, reproduced, republished, sold, downloaded, posted, transmitted or distributed in any way, or otherwise used for any purpose, by any person or entity, without our prior express written permission. You may not add, delete, distort, or otherwise modify the Proprietary Information. Any unauthorized attempt to modify any Proprietary Information, to defeat or circumvent any security features, or to utilize our Platforms or any part of the Proprietary Information for any purpose other than its intended purposes is strictly prohibited.

 

N. NOTIFICATION OF ERRORS

If you encounter any error while viewing any content on our Platform, kindly notify us of the same at the earliest either by mail or phone. 
 

O. TERMINATION

i. If at any time you wish to terminate your registration as a member, or withdraw your consent from storing and processing of Personal Data, kindly notify us of your intention by sending us a mail to the e-mail id given hereunder.

ii. TADA Sdn Bhd reserves the right to suspend or terminate your use of Sika MY Rewards App, if we believe, in our sole and absolute discretion that you have infringed, breached, violated, abused, or unethically manipulated or exploited any term of these Terms of Use or anyway otherwise acted unethically. In such an event, all points that have been accumulated by you shall stand forfeited and you shall not be entitled to any compensation or redemption of any accumulated points. 

 

P. JURISDICTION AND GOVERNING LAW

i. TADA Sdn Bhd makes no representation that materials in the Platform are appropriate or available for use in other locations/countries other than Malaysia or conditions different from the information provided by you. In the event the Platform is accessed from outside Malaysia, it shall be deemed that the cause of action in any dispute under this Agreement has arisen in Malaysia.

ii. These terms shall be governed by and constructed in accordance with the laws of Malaysia without reference to conflict of laws principles and disputes arising in relation hereto shall be subject to the exclusive jurisdiction of the High Court of Malaysia. All parties to this Agreement hereby hereto submit to the exclusive jurisdiction of the Malaysia Judiciary System and Laws.

 

Q. FORCE MAJEURE

TADA Sdn Bhd and Organizer/Sika shall not be liable and to the extent, that the performance or delay in performance of any of its obligations are prevented, restricted, delayed or interfered with due to circumstances beyond the reasonable control and without the fault or negligence of such Party, including but not limited to change in legislation, fire, flood, explosion, epidemic, pandemic, accident, act of God, war, riot, strike, lockout, traffic or other concerted act of workmen and/or act of Government.

R. SEVERABILITY

If any of these Terms of Use should be determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these Terms of Use are intended to be effective, then to the extent and within the jurisdiction where that term is illegal, invalid or unenforceable, it shall be severed and deleted and the remaining Terms of Use shall survive, remain in full force and effect and continue to be binding and enforceable. 
 

S. CONFIDENTIALITY

TADA Sdn Bhd and the Organizer/Sika agrees to keep all Personal Data and/or Sensitive Personal Data confidential and not to disclose it to any third party except as permitted under this Agreement, or express written consent of the Member/User or as required by law.

The Organizer/Sika shall not access, collect, transmit any information on the Product price to any distributors or retailers or influence any pricing information regarding the resale prices of products of the Organizer/Sika distributors and retailers. 

T. LEGAL DISCLAIMER

i) This Program is designed solely as a consumer loyalty initiative and is not intended to promote or facilitate any form of gambling, betting or wagering under the Common Gaming House Act 1953 and/or the Betting Act 1953 or related Malaysian Statutes. 

ii) The issuance of points is assured upon successful validation of purchases, with only the number of points and rewards determined probabilistically, thereby ensuring no element of risk or loss on the part of participants. 

iii) Sika does not engage in or promote collusive or anti-competitive conduct and remains fully compliant with the Competition Act 2010. Receipt collection is solely for purchase verification, and does not imply monitoring or influence over distributor’s pricing. 

iv) This Program also complies with the Malaysian Anti-Corruption Commission Act 2009, and no rewards are offered in exchange for improper influence or business advantage. 

 

PRIVACY NOTICE

A. This privacy statement (along with the Privacy Policy of Sika) outline in general terms how we collect, use and disclose Personal Information in respect of the Sika MY Rewards Program, in accordance with the Personal Data Protection Act 2010 (PDPA) Malaysia. Member hereby agrees and gives its express consent to Sika to collect, process, store, and use Personal Information in compliance with the PDPA. Sika will only use your Personal Information to the extent that it is necessary to fulfil the purposes described below:

i. To provide and improve our services in relation to the Sika MY Rewards Program (bases on contract, consent, or legitimate interest). 

ii. To provide information and communications; to conduct questionnaires relating to products, services, various events, campaigns, and similar matters (based on consent or legitimate interests)

iii. To conduct sales analysis, investigations, and research; to develop new program and products (based on legitimate interests)

iv. To conduct web analytics (see our Cookie Policy).

v. To ensure compliance with legal obligations (such as record keeping obligations), export control and customs, compliance screening obligations (including preventing white-collar or money laundering crimes), and compliance with our policies or industry standards (based on legal obligations or legitimate interests)

vi. To resolve disputes, enforce our contractual agreements and to establish, exercise or defend legal claims (based on legal obligations or legitimate interests)

 

B. Member information contained in Sika@MYRewards Program may be collectedfrom two sources:

i. Information provided by Sika to establish Member’s Sika® MY Rewards – End User Retail Customers Loyalty program account. This is required to enable access to, and use of, the Sika MY Rewards Program, which includes the program platform, functionality, service center and all related services. This information may only be updated with the authority of Sika. If you consider this information needs to be corrected or updated, you may contact Customer Service via email, telephone and/or Whatsapp, in accordance with your rights under the PDPA. 

ii. Information provided by Member at registration and during use of the Sika MY Rewards Program through variable account information fields. Member may insert, alter and remove information. Member remains responsible for the accuracy of this information.

C. Personal Information is collected from the Members by Sika and TADA Sdn Bhd to:

i. provides and improve the Sika MY Rewards Program and services.

ii. personalise Member experience.

iii. verify Member identity.

iv. communicate regarding orders, deliveries and Member’s account.

v. send program and commercial correspondence (if you have not unsubscribed to it).

vi. provide service support.

vii. conduct market research and trend analysis.

viii. market goods and services to you, (with your consent, in accordance with PDPA).ix. comply with any legal obligations.

 

D. Member shall not provide Personal Information of others to Sika through the Sika MY Rewards Program, unless permitted under the PDPA and with proper consent. Each Member’s Personal Information will be collected, processed, and used solely with their consent.
 

E. Members agree and consent that Sika may collect and process the Personal Information provided through the Program platform and email, including but not limited to : 

i. User’s personal data – such as name, address, date of birth, religion, postal address, email address, selected password.

ii. Device and usage information – including device model, operating system, IP address, language, carrier, and information about the use of features and functions to recognize you and analyse trends (processed on the basis of legitimate interest). 

iii. Website analytics –such as frequency of use, aggregated usage, and performance data (processed based on legitimate interest, to analyse trends and improved services).

 

F. Members are required to provide mandatory information (last name, first name, email, and mobile number) for account creation and sign-up. Optional variable fields may be completed at Member’s discretion. This information is collected at the time of enrolment through the Sika MY Rewards Program platform.
 

G. Members agree and consent that their collected Personal Information may be disclosed to:

i. Suppliers and third parties that assist in providing and improving goods and services (such as fulfilling and delivery of rewards, identity verification, market research and trend analysis, marketing and promotions, information technology support and service support operations);

ii. Relevant authorities where fraudulent activity is suspected or where required by law.

iii. Sika group companies and affiliates for the purposes of improving goods and services and ensuring that the Sika® MY Rewards – End User Retail Customers Loyalty Program meets its objectives.I. Member may opt-out of receiving program and commercial correspondences at any time via the Sika® MY Rewards Program Platform in accordance with their rights under the PDPA.

Cross-Border Data Transfer

A. In the course of Sika®MY Rewards operation, it may be necessary for Sika to transfer Member’s personal data to entities or servers located outside of Malaysia. Such transfer may occur for purposes including but not limited to data storage, backup, or the provisions of support or services by our affiliates, subsidiaries, or third-party service providers.

B. Sika will take all reasonable steps to ensure that any such transfer comply with the requirements of the Personal Data Protection Act 2010. Where the destination jurisdiction does not offer an equivalent level of data protection, Sika will ensure that appropriate safeguards are in place, including contractual obligations and technical measures, to secure Member’s personal data.

C. By continuing to interact with Sika, Member consent to such cross-border data transfer in accordance with this Privacy Notice. 

 

Third Party Data Processor

A. Sika may engage third party to perform functions on our behalf, including but not limited to data hosting, processing payments, marketing, analytics, or other operational tasks. In such cases, Sika will ensure that these third-party service providers are bound by strict contractual obligations to process personal data in accordance with Sika’s instructions and in compliance with the Personal Data Protection Act 2010. 

B. Sika require all such service providers to implement appropriate security measures and to maintain the confidentiality of the personal data they handled. These providers are not permitted to use Member’s personal data for any purpose other than to provide the contracted services. 


Changes to Terms and Conditions

Organizer/Sika reserves the right to change and update our terms and conditions when required. Whilst these changes may be made without prior notice, we will notify users of any major updates to ensure full transparency. We will take all necessary measures to comply with applicable Malaysian laws and regulations, including the PDPA. 

 

Notis Privasi

 

A. Pernyataan privasi ini (bersama dengan Polisi Privasi Sika) secara umum menerangkan bagaimana kami mengumpul, menggunakan dan mendedahkan Maklumat Peribadi berkenaan dengan Program Ganjaran Sika MY Rewards, selaras dengan Akta Perlindungan Data Peribadi 2010 (PDPA) Malaysia. Ahli dengan ini bersetuju dan memberikan kebenaran secara nyata kepada Sika untuk mengumpul, memproses, menyimpan, dan menggunakan Maklumat Peribadi selaras dengan PDPA. Sika hanya akan menggunakan Maklumat Peribadi anda sejauh mana yang perlu untuk memenuhi tujuan yang diterangkan di bawah:

i. Untuk menyediakan dan menambah baik perkhidmatan kami berkaitan dengan Program Ganjaran Sika MY Rewards (berdasarkan kontrak, kebenaran, atau kepentingan yang sah).

ii. Untuk menyediakan maklumat dan komunikasi; menjalankan soal selidik berkaitan produk, perkhidmatan, pelbagai acara, kempen, dan perkara yang serupa (berdasarkan kebenaran atau kepentingan yang sah).

iii. Untuk menjalankan analisis jualan, penyiasatan, dan penyelidikan; membangunkan program dan produk baharu (berdasarkan kepentingan yang sah).

iv. Untuk menjalankan analitik web (lihat Polisi Kuki kami).

v. Untuk memastikan pematuhan dengan kewajipan undang-undang (seperti kewajipan penyimpanan rekod), kawalan eksport dan kastam, kewajipan pemeriksaan pematuhan (termasuk pencegahan jenayah kolar putih atau pengubahan wang haram), dan pematuhan dengan polisi kami atau piawaian industri (berdasarkan kewajipan undang-undang atau kepentingan yang sah).

vi. Untuk menyelesaikan pertikaian, menguatkuasakan perjanjian kontrak kami dan untuk mewujudkan, menggunakan atau mempertahankan tuntutan undang-undang (berdasarkan kewajipan undang-undang atau kepentingan yang sah).

 

B. Maklumat ahli yang terkandung dalam Program Sika@MYRewards boleh dikumpulkan dari dua sumber:

i. Maklumat yang diberikan oleh Sika untuk menubuhkan akaun program kesetiaan Pelanggan Runcit Pengguna Akhir Sika® MY Rewards Ahli. Ini diperlukan untuk membolehkan akses kepada, dan penggunaan, Program Ganjaran Sika MY Rewards, yang merangkumi platform program, fungsi, pusat servis dan semua perkhidmatan berkaitan. Maklumat ini hanya boleh dikemas kini dengan kebenaran Sika. Jika anda berpendapat maklumat ini perlu dibetulkan atau dikemas kini, anda boleh menghubungi Khidmat Pelanggan melalui e-mel, telefon dan/atau WhatsApp, selaras dengan hak anda di bawah PDPA.

ii. Maklumat yang diberikan oleh Ahli semasa pendaftaran dan penggunaan Program Ganjaran Sika MY Rewards melalui medan maklumat akaun yang berubah-ubah. Ahli boleh memasukkan, mengubah dan mengeluarkan maklumat. Ahli kekal bertanggungjawab ke atas ketepatan maklumat ini.


C. Maklumat Peribadi dikumpul daripada Ahli oleh Sika dan TADA Sdn Bhd untuk:

i. menyediakan dan menambah baik Program Ganjaran Sika MY Rewards dan perkhidmatan.

ii. memperibadikan pengalaman Ahli.

iii. mengesahkan identiti Ahli.

iv. berkomunikasi mengenai pesanan, penghantaran dan akaun Ahli.

v. menghantar surat-menyurat program dan komersial (jika anda tidak berhenti melanggan).

vi. menyediakan sokongan perkhidmatan.

vii. menjalankan penyelidikan pasaran dan analisis trend.

viii.memasarkan barang dan perkhidmatan kepada anda (dengan kebenaran anda, selaras dengan PDPA).ix. mematuhi sebarang kewajipan undang-undang.



D. Ahli tidak boleh memberikan Maklumat Peribadi orang lain kepada Sika melalui Program Ganjaran Sika MY Rewards, melainkan dibenarkan di bawah PDPA dan dengan kebenaran yang sewajarnya. Maklumat Peribadi setiap Ahli akan dikumpulkan, diproses dan digunakan hanya dengan kebenaran mereka.


E
. Ahli bersetuju dan memberi kebenaran bahawa Sika boleh mengumpul dan memproses Maklumat Peribadi yang diberikan melalui platform Program dan e-mel, termasuk tetapi tidak terhad kepada:

i. Data peribadi pengguna – seperti nama, alamat, tarikh lahir, agama, alamat pos, alamat e-mel, kata laluan yang dipilih.

ii. Informasi peranti dan penggunaan – termasuk model peranti, sistem operasi, alamat IP, bahasa, pembekal rangkaian, dan maklumat tentang penggunaan ciri dan fungsi untuk mengenali anda dan menganalisis trend (diproses berdasarkan kepentingan yang sah).

iii. Analitik laman web – seperti kekerapan penggunaan, penggunaan agregat, dan data prestasi (diproses berdasarkan kepentingan yang sah, untuk menganalisis trend dan menambah baik perkhidmatan).


F. Ahli dikehendaki memberikan maklumat wajib (nama akhir, nama pertama, e-mel, dan nombor mudah alih) untuk penciptaan akaun dan pendaftaran. Medan berubah-ubah yang lain boleh diisi mengikut budi bicara Ahli. Maklumat ini dikumpulkan semasa pendaftaran melalui platform Program Ganjaran Sika MY Rewards.

 

G. Ahli bersetuju dan memberi kebenaran bahawa Maklumat Peribadi yang dikumpulkan boleh didedahkan kepada:

i. Pembekal dan pihak ketiga yang membantu dalam menyediakan dan menambah baik barangan dan perkhidmatan (seperti pemenuhan dan penghantaran ganjaran, pengesahan identiti, penyelidikan pasaran dan analisis trend, pemasaran dan promosi, sokongan teknologi maklumat dan operasi sokongan perkhidmatan);

ii. Pihak berkuasa berkaitan jika aktiviti penipuan disyaki atau seperti yang dikehendaki oleh undang-undang.

iii. Syarikat kumpulan dan sekutu Sika untuk tujuan menambah baik barangan dan perkhidmatan serta memastikan Program Kesetiaan Pelanggan Runcit Pengguna Akhir Sika® MY Rewards mencapai objektifnya.



H. Ahli boleh memilih untuk berhenti menerima surat-menyurat program dan komersial pada bila-bila masa melalui Platform Program Ganjaran Sika MY Rewards selaras dengan hak mereka di bawah PDPA.

Pemindahan Data Merentasi Sempadan

A. Dalam menjalankan program Sika®MY Rewards, mungkin terdaoat keperluan untuk memindahkan data peribadi Ahli ke entity atau pelayan yang terletak di luar Malaysia. Pemindahan ini mungkin berlaku bagi tujuan seperti penyimpanan data, sandaran, atau penyediaan sokongan dan perkhidmatan oleh Syarikat gabungan, anak Syarikat, atau penyedia perkhidmatan pihak ketiga Sika. 

B. Sika akan mengambil semua langkah yang munasabah untuk memastikan bahawa sebarang pemindahan tersebut mematuhi keperluan di bawah Akta Perlindungan Data Peribadi 2010 dan pindaan terkininya. Sekiranya negara penerima tidak mempunyai tahap perlindungan data yang setara, Sika akan mamastikan bahawa langkah-langkah perlindungan yang sesuai, termasuk kewajipan kontrak dan langkah teknikal, dilaksanakan untul melindungi data peribadi Ahli. 

C. Dengan terus berinteraksi dengan Sika, Ahli bersetuju dengan pemindahan data merentasi sempadan seperti yang dinyatakan dalam Notis Privasi ini. 

 

Pemproses Data Pihak Ketiga

A. Sika mungkin melantik pihak ketiga untuk menjalankan fungsi tertentu bagi pihak Ahli, termasuk tetapi tidak terhad kepada penyimpanan data, pemprosesan pembayaran, pemasaran, analitik, atau tugas operasi lain. Dalam kes sedemikian, kami akan memastikan bahawa penyedia perkhidmatan pihak ketiga ini terikat dengan kewajipan kontrak yang ketat untuk memproses data peribadi mengikut arahan Sika dan mematuhi Akta Perlindungan Data Peribadi 2010. 

B. Sika memerlukan semua penyedia perkhidmatan tersebut untuk melaksanakan langkah-langkah keselamatan yang sesuai dan mengekalkan kerahsiaan data peribadi yang mereka kendalikan. Penyedia perkhidmatan ini tidak dibenarkan menggunakan data peribadi Ahli untuk tujuan lain selain daripada menyediakan perkhidmatan yang telah dipesetujui. 

 

Perubahan kepada Terma dan Syarat

Penganjur/Sika berhak untuk mengubah dan mengemas kini terma dan syarat kami apabila diperlukan. Walaupun perubahan ini boleh dibuat tanpa notis awal, kami akan memaklumkan pengguna tentang sebarang kemas kini utama untuk memastikan ketelusan sepenuhnya. Kami akan mengambil semua langkah yang perlu untuk mematuhi undang-undang dan peraturan Malaysia yang berkenaan, termasuk PDPA.
